Terms of Service

1. Eligibility

You must be at least 13 years of age to use SwipeAce. If you are under the age of majority in your jurisdiction, you may only use the Services with the consent and involvement of a parent or legal guardian.

By using the Services, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and complete.

2. Account Registration and Login

• You may register using an email address and password, or via Single Sign-On (SSO) providers such as Sign in with Apple or Sign in with Google.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to notify us immediately at hello@swipeace.app if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or are involved in fraudulent activity.

3. Use of the Services

SwipeAce grants you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial study purposes.

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws.
• Reproduce, distribute, or create derivative works from our content without explicit written permission.
• Attempt to reverse engineer, decompile, or otherwise extract the source code of the Services.
• Use automated tools, bots, or scrapers to access or collect data from the Services.
• Interfere with or disrupt the integrity or performance of the Services or its infrastructure.
• Upload content that is unlawful, infringing, harmful, or violates the rights of any third party.

4. User Content

You retain ownership of any study materials, notes, PDFs, or other content you upload to SwipeAce ("User Content"). By uploading content, you grant us a limited, worldwide, royalty-free license to process and use that content solely to provide the Services to you (e.g., generating flashcards and quizzes).

You represent and warrant that:

• You own or have the necessary rights to upload the content.
• Your content does not infringe any third-party intellectual property, privacy, or other rights.
• Your content does not contain malware, illegal material, or anything that violates these Terms.

We reserve the right to remove any User Content that violates these Terms without prior notice.

5. AI-Generated Content

SwipeAce uses artificial intelligence to generate flashcards, quizzes, and study materials based on your uploaded content. You acknowledge that:

• AI-generated content may contain errors or inaccuracies and should not be relied upon as a substitute for professional or academic advice.
• We make no guarantees regarding the accuracy, completeness, or suitability of AI-generated content for any specific purpose.
• You are responsible for verifying the accuracy of any generated material before use.

6. Analytics

By using the Services, you agree that we may collect usage and performance data to analyze how the Services are used and to improve them. This includes:

• Feature interactions, session duration, and navigation patterns.
• Crash reports and error logs.
• Device and platform information (OS version, app version).

Analytics data is collected in an aggregated or anonymized manner where possible. You may opt out of certain analytics collection through your device privacy settings.

7. Advertising

The free tier of SwipeAce may display third-party advertisements. By using the free tier, you agree that:

• Ads may be served based on contextual signals or, subject to your device privacy settings, your advertising identifier.
• We and our advertising partners may collect data relating to ad impressions, clicks, and attribution in accordance with our Privacy Policy.
• You can limit personalized advertising at any time through your device settings ("Limit Ad Tracking" on iOS or "Opt out of Ads Personalization" on Android).

Upgrading to a paid subscription removes ads from the Services.

8. Subscriptions and Payments

• Free Tier: SwipeAce offers limited features at no cost. Access to premium features requires a paid subscription.
• RevenueCat: In-app subscriptions and purchases are managed through RevenueCat, which processes purchase receipts from the Apple App Store and Google Play Store. RevenueCat's terms are available at revenuecat.com/terms.
• Billing: Subscriptions are billed on a recurring basis (monthly or annually) through the App Store or Google Play. By subscribing, you authorize the respective app store to charge your payment method on a recurring basis.
• Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests are handled in accordance with the App Store or Google Play refund policies. We may share usage data with the relevant app store to assist in evaluating refund requests.
• Price Changes: We reserve the right to modify subscription pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.

9. Data Storage

Your account data, uploaded study materials, and generated content are stored using Supabase, a secure cloud infrastructure provider. Subscription entitlement data is stored by RevenueCat. By using the Services, you agree to this storage.

• Data is retained for as long as your account is active or as required to fulfill our legal obligations.
• You may request deletion of your data at any time by contacting us at hello@swipeace.app.
• Upon account deletion, your personal data and study materials will be permanently removed from our systems within a reasonable timeframe, except where retention is required by law.

10. Intellectual Property

All content, features, and functionality of the Services — including but not limited to the SwipeAce name, logo, design, software, and AI models — are owned by or licensed to SwipeAce and are protected by applicable intellectual property laws.

Nothing in these Terms grants you any right to use SwipeAce's intellectual property other than as expressly permitted herein.

11. Third-Party Services

The Services rely on third-party providers including:

• Supabase — database, storage, and authentication infrastructure.
• RevenueCat — subscription and in-app purchase management.
• Apple / Google — app distribution and payment processing.
• AI service providers — powering flashcard and quiz generation.
• Analytics and advertising providers — as described in Sections 6 and 7.

Your use of the Services is subject to the respective terms and policies of these providers. We are not responsible for their actions or data practices.

12. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure. Use of the Services is at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, SwipeAce and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless SwipeAce and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Services, your User Content, or your violation of these Terms.

15. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties.

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall remain in effect.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the app or email. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

17. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation in the first instance. If unresolved, disputes shall be subject to binding arbitration or the courts of the applicable jurisdiction.
